1. Acceptance of Terms
By downloading, installing, or using the TrafficWatch mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). The App is operated by Tebibyte Infotech ("we", "us", or "our"), a company registered in India. If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Tebibyte Infotech. We reserve the right to update these Terms at any time, and we will notify you of significant changes via push notification or email.
2. Description of Service
TrafficWatch is a real-time traffic monitoring application designed for Indian roads. The App provides:
- Real-time traffic condition monitoring on user-saved routes
- Push notification alerts for traffic changes and incidents
- Historical traffic pattern analysis and best-time-to-travel recommendations
- Live route monitoring with GPS tracking
Traffic data is sourced from HERE Maps API and may not always reflect real-time ground conditions with complete accuracy. TrafficWatch is an informational tool and should not be relied upon as the sole basis for travel decisions.
3. Eligibility
You must be at least 13 years of age to use TrafficWatch. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.
4. User Accounts
4.1 Registration
You may create an account using Google Sign-In. You are responsible for maintaining the security of your Google account credentials and for all activity that occurs under your account.
4.2 Guest Mode
TrafficWatch offers a guest mode with limited functionality. Guest mode does not require registration and does not collect any personal data. Guest users cannot save routes, receive push notifications, or access Premium features.
4.3 Account Deletion
You may delete your account at any time from within the App (Settings > Account > Delete Account). Upon deletion, all personal data associated with your account will be permanently erased within 30 days, in accordance with our Privacy Policy.

5.1 Premium Subscription
The Premium subscription is billed annually at ₹99/year through Google Play. By subscribing, you authorise Google Play to charge the applicable fee to your chosen payment method. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
5.2 Cancellation and Refunds
You may cancel your Premium subscription at any time through Google Play Store settings. Upon cancellation, you will retain Premium access until the end of the current billing period. Refund requests are subject to Google Play's refund policy.
5.3 Price Changes
We reserve the right to modify subscription pricing. Existing subscribers will be notified at least 30 days before any price change takes effect. Price changes will not apply until the start of the next billing cycle.
6. Acceptable Use
You agree not to:
- Use the App while driving or operating a vehicle in a manner that compromises safety
- Attempt to reverse-engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's servers, networks, or infrastructure
- Use automated scripts, bots, or scrapers to access the App
- Use the App for any unlawful, fraudulent, or malicious purpose
- Attempt to gain unauthorised access to other users' accounts or data
- Redistribute, sublicense, or resell the App or its content
- Submit false incident reports or misleading traffic information
Violation of these terms may result in immediate suspension or termination of your account without prior notice.
7. Intellectual Property
All content, features, and functionality of TrafficWatch, including but not limited to the App design, code, graphics, logos, icons, and text, are the exclusive property of Tebibyte Infotech and are protected by Indian and international copyright, trademark, and intellectual property laws.
The TrafficWatch name, logo, and all related marks are trademarks of Tebibyte Infotech. You may not use these marks without our prior written permission.
8. Third-Party Services
TrafficWatch relies on third-party services to deliver its functionality:
- HERE Maps API: For traffic data and route information, subject to HERE's Terms of Service
- Google Sign-In: For authentication, subject to Google's Terms of Service
- Firebase Cloud Messaging: For push notification delivery
- Google Play Billing: For subscription payment processing
We are not responsible for the availability, accuracy, or policies of these third-party services. Disruptions in third-party services may affect App functionality, and such disruptions are beyond our control.
9. Disclaimers
Important: TrafficWatch is provided on an "as is" and "as available" basis. Traffic information is sourced from third-party providers and may not always be accurate or up-to-date. Always exercise your own judgement when making travel decisions.
9.1 No Warranty
To the maximum extent permitted by applicable law, Tebibyte Infotech disclaims all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
9.2 Traffic Data Accuracy
We do not guarantee the accuracy, completeness, or timeliness of traffic information displayed in the App. Traffic conditions change rapidly and our data may not reflect real-time ground conditions. You should always verify conditions independently before making critical travel decisions.
9.3 Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the App. The service may be temporarily unavailable due to maintenance, updates, server issues, or factors beyond our control.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Tebibyte Infotech and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to:
- Losses arising from reliance on traffic data provided by the App
- Missed appointments, delayed travel, or route selection based on App information
- Data loss resulting from account deletion or service interruption
- Any damages resulting from unauthorised access to your account
In no event shall our total aggregate liability exceed the amount you paid for Premium subscription in the twelve (12) months preceding the claim, or ₹99, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless Tebibyte Infotech, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your misuse of the App, or your violation of any applicable law or regulation.
12. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, fraudulent activity, or extended inactivity.
Upon termination:
- Your right to use the App ceases immediately
- Your account data will be deleted in accordance with our Privacy Policy
- Any active Premium subscription will be cancelled (prorated refunds at our discretion)
You may terminate your use of the App at any time by deleting your account and uninstalling the App.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts located in India.
Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days. Disputes may also be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India).
14. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tebibyte Infotech regarding the use of TrafficWatch, and supersede all prior agreements, understandings, and communications, whether written or oral.
